SC Agrees to Hear Plea Seeking CEC Gyanesh Kumar's Suspension Next Week
Key Highlights
  • The Supreme Court agreed on Tuesday to hear next week a PIL seeking the suspension of Chief Election Commissioner Gyanesh Kumar over how the Election Commission has been taking decisions during the SIR of electoral rolls.

The plea, filed by Patna resident Rakesh Kumar Singh, alleges that decisions belonging to the multi-member Election Commission were taken unilaterally by CEC Gyanesh Kumar without the concurrence of Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi. The petition seeks a direction restraining Kumar from functioning as Chief Election Commissioner pending final adjudication. It proposes that the Commission's work in the meantime be carried out through unanimous decisions of Sandhu and Joshi. The plea also seeks the production of the Election Commission's original records and an independent judicial inquiry or Special Investigation Team headed by a retired Supreme Court judge. Senior advocate Vikas Singh mentioned the matter before a bench headed by Chief Justice Surya Kant, who agreed to list it for hearing next week. The petition relies on written objections that Sandhu and Joshi are reported to have recorded at least 14 times over the past 10 months against SIR-related decisions and orders that they allegedly said were issued without their knowledge. The Union Law Ministry, Election Commission, CEC Kumar, Sandhu, Joshi and senior poll panel official Maneesh Garg have been named as parties in the petition. This is the second such petition concerning Kumar, with an earlier plea seeking his criminal prosecution. The Election Commission has maintained that differences of opinion among commissioners are a normal part of institutional deliberation. The allegations made in the petition have not been established by the court.
