A bench of Justices Joymalya Bagchi and V Mohana told the counsel appearing for the petitioner that "whether a person is a bus conductor or a secretary of the state, everyone has an equal right to access justice." The petitioner, a former judicial officer, has challenged his termination from service before the Allahabad High Court and approached the apex court seeking priority treatment for his pending plea. His counsel told the bench that due to the huge burden of cases before the High Court, the plea had not yet been decided. The bench observed that asking the High Court to accord priority to the petitioner's case over others would be unfair to the many other litigants who are also waiting their turn for adjudication. "In this space of constitutional equality, we will not create individualistic interventions," the bench said, declining to entertain the petition and directing the petitioner to pursue the matter before the appropriate court. The remark reflects a broader principle the apex court has repeatedly invoked in matters involving requests for preferential listing, emphasising that the judicial system must treat all litigants on an equal footing regardless of their professional background or prior position.
